Creation of a new form of incorporation of non-profit organizations - State Enterprise. Establishment of State Enterprise

The Federal law dated July 17, 2009 No.145-FZ “On state enterprise “Russian motorways" established a new form of incorporation of non-profit organizations - a state enterprise. Such an enterprise shall have no participants and shall be established by the Russian Federation based on property contributions for the purposes of rendering state services and performing other functions in the sphere of road facilities using federal property under trust management.

A state enterprise shall be established without limitation of period of its operation. Such a Company shall have right to carry out profit-making activities which correspond to purposes it is established for just because it is established to achieve these goals.

State enterprise “Russian motor ways” ("Avtodor") (hereinafter - SE "Avtodor") shall be responsible for a federal road infrastructure with heavy traffic.

SE “Avtodor” shall transfer federal motor ways for trust management. It has been granted a right to act as a customer for design, construction, reconstruction and maintenance of federal motor ways for budget allocations and non-budgetary financing sources. Besides, SE "Avtodor" shall undertake motorway service. The company has been granted a right to dispose of land lots in the easement areas of motorways under its ownership and to derive an income without, however, being allowed to transfer them.
