Valdimir Kilinkarov, a partner in MCL takes an active role in the elaboration of the CIS model law.
Vladimir Kilinkarov, a partner in MCL, is one of the leading members of the working group engaged in drafting of the model law "On Public Private Partnership" for the CIS member states.
The lawmakers focus on the approximation (harmonisation) of legislations of the CIS member states, the ensuring uniform and consistent state regulation in the area of public private partnership (PPP) in the CIS, the elimination of gaps and defects in national statutory and regulatory regulation of activity carried out in the form of PPP.
The working group under the leadership of Vladimir Fedorovich Popondopulo, J.D., a professor of the Law Faculty of the Saint Petersburg State University, was formed in autumn 2012 upon the victory won by the Saint Petersburg State University in the competition held by the Interparliamentary Assembly of Member Nations of the Commonwealth of Independent States. The working group consists of those leading specialists of the Law Faculty of the Saint Petersburg State University in the area of civil, commercial and administrative law who have performed scientific and practical groundwork in the area of the organisation of public private partnerships and rendering public services.
Vladimir Kilinkarov, PHD in law, a partner in MCL, responsible for the elaboration of some general provisions of the model law, provisions on the contractual and institutional (corporate) form of the public private partnership and for the preparation of the draft law in general and Yelena Kilinkarova, PHD in law, associate professor of the Law Faculty of the Saint Petersburg State University, a Counsel in MCL, focusing on drafting provisions on the selection of private partners, organising and holding tenders for the right to enter into a public private partnership agreement are two of the most active members of the working group.
The main purpose of the working group is to compose harmonised and comprehensive provisions, ensuring ample opportunities for the stable development of public private partnerships with a view to attract private investments to different scale infrastructure projects. In order to achieve these objectives the members of the working group actively analyse Russian and foreign experience related to legal regulation and PPP projects structuring, as well as recommendations of international organisations, including UNCITRAL, UNECE, OECD, EC bodies and others.
At the moment the concept of the PPP model law for the CIS member states and the review of the PPP regulation practice of the CIS member states, other former USSR countries, other states and international organisations have been approved.
The first version of the said model law was submitted to the Permanent Commission of the Interparliamentary Assembly of Member Nations of the Commonwealth of Independent States in February 2013. It will subsequently be brought up for discussion and delivered to the parliaments of the CIS member states for them to comment and propose. Adoption of the final version of the model law is scheduled to be reviewed at the Interparliamentary Assembly of Member Nations of the Commonwealth of Independent States at the end of 2013.
