Maxima Legal protected rights of Nevsky Bereg lenders
On 12 March 2014 the Arbitrazh Court of Saint Petersburg and the Leningrad Region delivered an award on the invalidation of the sale of one of the largest malt houses in Russia located in the suburb of Saint Petersburg and its return to CJSC Nevsky Bereg.
Nevsky Bereg malt house was built and put into operation by business partners, Andrei Mansky and Konstantin Barinov, in the end of 2008. However, in the end of 2010 the malt house having book value exceeding 1.4 billion roubles was sold for a little more than 400 million roubles.
The sale was preceded by filing a CJSC Nevsky Bereg bankruptcy petition and a corporate conflict between its co-owners who also owned Deka LLC, the largest kvas manufacturer in Russia. As a result of the sale of the malt house the lenders of CJSC Nevsky Bereg were deprived of the chance to have their demands to the aggregate amount of 2 billion roubles satisfied.
Maxima Legal lawyers represent several lenders of CJSC Nevsky Bereg with regard to the bankruptcy case and a number of related proceedings including the same on challenging the sale of the malt house. In the course of litigation which lasted for two years Maxima Legal lawyers managed to defend the interests of the lenders. The lawyers successfully obtained a judgment for the return of property unlawfully excluded from bankrupt's estate.
