Maxim Ali has discussed with Rusbase about the value of patents
On 18 July, website rb.ru published an article titled, ‘Why start-ups no longer need patents – the opinions of an entrepreneur’, which considered how intellectual property can be protected and whether this requires a patent or not.
Senior Associate at Maxima Legal, Maxim Ali considered that patents for inventions cannot always be issued and are often simply not required as the rights can be protected by other means that are not connected with the difficult process of filing for a patent. New developments or inventions of a company can be protected, for example, as know-how or trade secrets.
In Maxim’s opinion, the expense of patenting an idea depends on many factors and, as a rule, at the stage of a client's initial enquiry, only a lower estimated cost for this can be established which does not represent the full final cost. An important consideration is the cost of lawyers and patent attorneys that the client may have to incur.
