Provisions Determining Liability for Breach of Antimonopoly Rules in the Course of Trade Activity have been Introduced to the RF Administrative Offences Code

For example, Article 14.40 of the RF Administrative Offences Code specifies that if a commercial entity, which conducts trade activity related to sale of food commodities by means of establishing a trade network or a commercial entity, which supplies food commodities to trade networks, creates discriminating conditions, including creating obstacles for other commercial entities to enter or exit commodity market, as a general rule it shall entail imposing of administrative fine on officers in the amount of twenty thousand to forty thousand rubles and administrative fine on legal entities in the amount of two million to five million rubles.
 
If a commercial entity, which conducts trade activity related to sale of food commodities by means of establishing a trade network or a commercial entity, which supplies food commodities to trade networks, imposes on its contractor those conditions that are prohibited by federal law, as a general rule it shall entail imposing of administrative fine on officers in the amount of thirty thousand to fifty thousand rubles and administrative fine on legal entities in the amount of two million five hundred thousand to five million rubles.
 
If a commercial entity, which conducts trade activity related to sale of food commodities by means of establishing a trade network and/or a commercial entity, which supplies food commodities to trade networks, wholesales on the basis of commission agreement or mixed agreement containing material terms and conditions of a commission agreement, it shall entail imposing of administrative fine on officers in the amount of ten thousand to fifty thousand rubles and administrative fine on legal entities in the amount of one million five hundred thousand to four million five hundred thousand rubles.
 
In addition, there is administrative liability imposed for breach of those requirements established by federal law that relate to provision of information on terms and conditions of entering into food commodities supply agreement under conducting of trade activity and liability for breach of those requirements established by federal law that relate to terms and conditions of entering into agreements of such kind.
